1. Сторони і предмет

Ця публічна оферта (далі — «Умови») регулює користування сервісом «Митник» (mytnyk.app, Telegram-бот і веб-панель; далі — «Сервіс»). Постачальник Сервісу: Lukbit FZCO — компанія вільної економічної зони, Об'єднані Арабські Емірати; адреса: [ADDRESS]; номер ліцензії: [LICENSE NO]; e-mail: [EMAIL] (далі — «Постачальник»). Користувач — митний брокер або митно-брокерське підприємство, що зареєструвалося в Сервісі (далі — «Брокер»). Реєстрація, початок пробного періоду або оплата означають повне й беззастережне прийняття цих Умов.

2. Опис Сервісу

Сервіс — програмне забезпечення за моделлю SaaS для митних брокерів: приймає документи клієнтів Брокера (з Telegram, e-mail, веб-панелі), розпізнає й класифікує їх за допомогою штучного інтелекту, групує в справи за VIN, формує перелік відсутніх документів, перевіряє ціну з даними аукціону, розраховує орієнтовні митні платежі та готує чернетки даних для митної декларації й інших документів.

3. Пробний період

Новий Брокер отримує безкоштовний пробний період: 30 днів або 20 справ — залежно від того, що настане раніше. Картка для пробного періоду не потрібна. Після його закінчення доступ до нових справ надається за оплатою; збережені справи не видаляються.

4. Ціни

  • «Старт» — 1 490 грн на місяць: 10 справ, 1 користувач, додаткова справа 149 грн;
  • «Про» — 3 490 грн на місяць: 40 справ, до 3 користувачів, додаткова справа 99 грн;
  • «Бізнес» — 5 900 грн на місяць: 100 справ, без обмеження користувачів, додаткова справа 59 грн;
  • без підписки: 249 грн за справу; пакети 10 справ — 1 990 грн, 25 справ — 4 490 грн (справи на балансі не згорають).

Актуальні ціни завжди вказані на сторінці mytnyk.app і в розділі «Тариф і оплата» веб-панелі. Ціни вказано в гривнях; податки, які застосовуються в країні покупця (наприклад, ПДВ), можуть бути додані під час оформлення замовлення відповідно до законодавства. Постачальник може змінювати ціни; нові ціни застосовуються з наступного розрахункового періоду після повідомлення Брокера.

5. Оплата, Paddle як продавець (Merchant of Record)

Процес замовлення здійснює наш онлайн-реселер Paddle.com. Paddle.com є продавцем (Merchant of Record) усіх наших замовлень: Paddle приймає оплату, видає рахунки й чеки, обробляє запити щодо оплати та повернення коштів. Під час оплати діють також умови Paddle для покупців (paddle.com/legal/checkout-buyer-terms). Дані платіжної картки обробляє Paddle; Постачальник їх не отримує й не зберігає.

6. Підписка, продовження і скасування

Тарифи «Старт», «Про» і «Бізнес» — щомісячні підписки, які автоматично продовжуються на наступний місяць із списанням оплати тим самим способом, доки Брокер їх не скасує. Скасувати підписку можна будь-коли: у веб-панелі «Тариф і оплата» → «Керувати підпискою / скасувати» (портал клієнта Paddle) або за посиланням у листі від Paddle. Після скасування подальших списань немає, а доступ за тарифом діє до кінця вже оплаченого місяця. Якщо автоматичне списання не вдалося, Paddle повторює спробу; якщо оплата так і не надійшла, після кінця оплаченого періоду доступ до нових справ припиняється. Разові покупки (справи, пакети справ) не є підпискою й не продовжуються.

7. Повернення коштів

Умови повернення — у Політиці повернення коштів.

8. Обов'язки Брокера

Брокер відповідає за законність отримання документів і персональних даних своїх клієнтів, за правильність даних, які він вносить, за збереження доступу до свого Telegram-акаунта і не використовує Сервіс з порушенням закону чи прав третіх осіб.

9. Обмеження відповідальності

Сервіс готує лише чернетки та підказки. Брокер самостійно перевіряє, підписує й подає митні декларації та інші документи до митних органів і одноосібно відповідає за них. Сервіс нічого не подає до митних органів від імені Брокера. Розрахунки платежів є орієнтовними; зразки інвойсів та інших документів є лише прикладами й не є юридичною чи податковою консультацією. Результати розпізнавання штучним інтелектом можуть містити помилки. Сервіс надається «як є»; Постачальник докладає розумних зусиль для його безперебійної роботи, але не гарантує її. У межах, дозволених законом, Постачальник не відповідає за непрямі збитки, упущену вигоду, штрафи чи донарахування митних органів, а загальна відповідальність Постачальника обмежується сумою, сплаченою Брокером за Сервіс протягом 3 місяців до події, що спричинила претензію.

10. Персональні дані (DPA)

Щодо персональних даних клієнтів Брокера (паспорти, РНОКПП, документи на авто тощо) Брокер є володільцем (контролером), а Постачальник — розпорядником (процесором), який обробляє їх лише за дорученням Брокера й лише для надання Сервісу. Постачальник: обробляє дані тільки за документованими інструкціями Брокера (ці Умови й дії Брокера в Сервісі); забезпечує конфіденційність і доступ лише уповноважених осіб; застосовує належні технічні й організаційні заходи захисту; залучає субпроцесорів (зокрема хостинг-провайдера сервера в Україні та Anthropic PBC для AI-обробки документів) з обов'язками захисту даних не нижчими за ці; допомагає Брокеру виконувати запити суб'єктів даних; повідомляє Брокера про порушення безпеки даних без зайвої затримки; після припинення договору видаляє або повертає дані відповідно до строків, зазначених у Політиці конфіденційності; надає інформацію, необхідну для підтвердження виконання цих обов'язків. 11. Строк дії, припинення

Договір діє з моменту прийняття Умов до його припинення. Брокер може будь-коли припинити користування Сервісом і скасувати підписку. Постачальник може призупинити доступ у разі суттєвого порушення цих Умов або несплати.

12. Зміни Умов

Постачальник може змінювати ці Умови, публікуючи нову редакцію на цій сторінці; про суттєві зміни Брокера повідомляють щонайменше за 14 днів. Продовження користування Сервісом після набрання чинності змінами означає згоду з ними.

13. Застосовне право і спори

До цих Умов застосовується право: [GOVERNING LAW / COURT]. Спори вирішуються шляхом переговорів, а в разі недосягнення згоди — у суді: [GOVERNING LAW / COURT]. Це не обмежує прав, які Брокер має як споживач за імперативними нормами законодавства своєї країни.

Terms of Service

Version of 05.11.2026. The Mytnyk service (mytnyk.app), Lukbit FZCO.

1. Parties and subject

These Terms of Service ("Terms") govern the use of the Mytnyk service (mytnyk.app, the Telegram bot and the web panel; the "Service"). The Service is provided by Lukbit FZCO, a free-zone company registered in the United Arab Emirates; address: [ADDRESS]; licence no.: [LICENSE NO]; e-mail: [EMAIL] (the "Provider"). The user is a customs broker or customs brokerage that has registered in the Service (the "Broker"). Registering, starting the trial or paying constitutes full acceptance of these Terms.

2. The Service

The Service is SaaS software for customs brokers: it receives the Broker's client documents (via Telegram, e-mail, the web panel), recognises and classifies them with artificial intelligence, groups them into cases by VIN, lists missing documents, cross-checks the price with auction data, estimates customs payments and prepares draft data for the customs declaration and other documents.

3. Free trial

A new Broker gets a free trial of 30 days or 20 cases, whichever comes first. No card is required for the trial. After the trial, new cases require payment; stored cases are not deleted.

4. Prices

  • Start — UAH 1,490 per month: 10 cases, 1 user, extra case UAH 149;
  • Pro — UAH 3,490 per month: 40 cases, up to 3 users, extra case UAH 99;
  • Business — UAH 5,900 per month: 100 cases, unlimited users, extra case UAH 59;
  • without a subscription: UAH 249 per case; packs of 10 cases — UAH 1,990, 25 cases — UAH 4,490 (prepaid cases do not expire).

Current prices are always shown on mytnyk.app and on the "Plan & billing" page of the web panel. Prices are in Ukrainian hryvnias; taxes applicable in the buyer's country (e.g. VAT) may be added at checkout as required by law. The Provider may change prices; new prices apply from the next billing period after notice to the Broker.

5. Payment; Paddle as Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms) also apply to the purchase. Card details are processed by Paddle; the Provider never receives or stores them.

6. Subscriptions, renewal and cancellation

The Start, Pro and Business plans are monthly subscriptions that renew automatically for the next month, charging the same payment method, until the Broker cancels. The Broker can cancel at any time: in the web panel under "Plan & billing" → "Manage subscription / cancel" (Paddle customer portal) or via the link in Paddle's e-mails. After cancellation no further charges are made and plan access continues until the end of the month already paid for. If a renewal charge fails, Paddle retries it; if no payment is received, access to new cases ends after the paid period. One-off purchases (cases, case packs) are not subscriptions and do not renew.

8. Broker's obligations

The Broker is responsible for lawfully obtaining its clients' documents and personal data, for the accuracy of data it enters, for keeping its Telegram account secure, and for not using the Service in breach of law or third-party rights.

9. Limitation of liability

The Service only prepares drafts and suggestions. The Broker alone reviews, signs and files customs declarations and other documents with the customs authorities and is solely responsible for them. The Service never files anything with customs on the Broker's behalf. Payment calculations are estimates; sample invoices and other documents are examples only and are not legal or tax advice. AI recognition may contain errors. The Service is provided "as is"; the Provider uses reasonable efforts to keep it available but does not guarantee uninterrupted operation. To the extent permitted by law, the Provider is not liable for indirect loss, lost profit, or fines or additional charges imposed by customs authorities, and the Provider's total liability is limited to the amount paid by the Broker for the Service in the 3 months before the event giving rise to the claim.

10. Personal data (data processing terms)

For the personal data of the Broker's clients (passports, tax numbers, vehicle documents, etc.) the Broker is the controller and the Provider is the processor, processing it only on the Broker's behalf and only to provide the Service. The Provider: processes the data only on the Broker's documented instructions (these Terms and the Broker's actions in the Service); ensures confidentiality and access by authorised persons only; applies appropriate technical and organisational security measures; engages sub-processors (including the hosting provider of the server in Ukraine and Anthropic PBC for AI document processing) under data protection obligations no less protective than these; assists the Broker in responding to data subject requests; notifies the Broker of a personal data breach without undue delay; deletes or returns the data after termination in line with the retention periods in the Privacy Policy; and makes available the information needed to demonstrate compliance. 11. Term and termination

The agreement runs from acceptance of these Terms until terminated. The Broker may stop using the Service and cancel the subscription at any time. The Provider may suspend access for material breach of these Terms or non-payment.

12. Changes

The Provider may amend these Terms by publishing a new version on this page; the Broker will be notified of material changes at least 14 days in advance. Continued use after the changes take effect means acceptance.

13. Governing law and disputes

These Terms are governed by: [GOVERNING LAW / COURT]. Disputes are settled by negotiation and, failing agreement, by the courts of: [GOVERNING LAW / COURT]. This does not limit any rights the Broker has as a consumer under mandatory law of its country.
